Privacy Policy - Shell Group Recruitment

This policy sets out what personal data we collect, for what purposes, and what your related rights are.

What does this Privacy Policy cover?

This Privacy Policy provides information about the personal data processed by company(ies) that are part of the Shell group ("Shell" or "we") in relation to individuals who are candidates for a vacancy or who attend a recruitment event or undergo an assessment at Shell. This includes potential employees, interns, and contractors.

For those hired as an employee, intern or contractor, the Privacy Policy – Shell Group Employee, Contractor and Dependents will apply.

Like this Privacy Policy, personalized and supplemental privacy policy statements and notices may also contain information about how Shell processes your personal data. In such cases, we will communicate to you about such privacy policies separately.

This Privacy Policy explains what personal data is processed, for what purposes, how long it is retained, how to access and update it, as well as the choices available about your personal data and where to find more information.

Who is responsible for any personal data collected?

DISA LUSITANIA, S.A., which is part of the "DISA GROUP" whose energy division is controlled by the company "DISA HOLDING Energético, SLU", with registered office at Calle Álvaro Rodriguez Lopes, Santa Cruz de Tenerife, 38003, Spain, will be responsible for processing your personal data, either unilaterally or jointly with its affiliates within the Shell business group.

If personal data of children is gathered this requires consent of the parent or guardian.

Special Notice - if you are under 18 years of age. Processing of children's personal data

Except for educational events organised by Shell that are designed specifically for children, we do not knowingly collect personal data from individuals under 18 years of age. If you are under 18 years of age, please do not submit your personal data, such as name, address and e-mail address. If you wish to contact Shell and this requires us to submit your personal data (such as for education or innovation events), please ask your parent or guardian to do this on your behalf.

The categories of personal data we collect about you.

What personal data do we process? Collection of information

We process personal information about individuals who apply for a job or who attend a recruitment event and/or undergo an assessment ("Candidates").

This includes personal contact information, date of birth, whether you have a legal right to work in the country in which you have applied, your job application, your qualifications and experience, interview results and assessments.

Sensitive personal data

For recruitment purposes, data from special categories ("sensitive personal data"), including personal data regarding health issues, may be processed only when there is strict necessity and when permitted or requested by local law to make adjustments to the recruitment process, to assess eligibility for positions and fitness for work, and also to equip the work environment with resources that can address health problems or define, Exercise or defend claims.

In addition, in order to ensure equal employment opportunities as permitted or required by local law, we may also collect additional sensitive data regarding Candidates, including their nationality, racial and/or ethnic origin.

The purposes for which we process your personal data.

For what purposes do we process your personal data?

We process your personal data for the following purposes:

  • Human Resources, personnel management, execution of business processes and internal management - resource planning and recruitment;
  • Health, safety and security – protection of an individual's life or health, occupational health and safety, protection of Shell assets and employees, authentication of individual status and access rights;
  • Legal and/or regulatory compliance – compliance with legal or regulatory requirements;
  • Management of reports and analysis - statistical analysis and research on the quality of the recruitment process.

We may also process your personal data for a secondary purpose, to which it is directly related, such as: 

  • storage, deletion or confidentiality of your personal data;
  • audits, investigations, fraud prevention, dispute resolution, insurance issues, litigation, and claims defense;
  • statistical, historical, or scientific research.

Pre-Evaluation of Candidates

We evaluate all Candidates who wish to apply for a job, internship or a service contract (as the case may be) and, prior to confirmation of any application, to:

  • verify the information provided by the Candidate during the assessment/interview process. This will include verifying information with current/previous employers and educational institutions. No process will be carried out in this regard until the Candidate authorizes the verification;
  • evaluation of Candidates with publicly available or government-issued sanctions lists and with media sources. This is done to comply with legal and regulatory obligations, to protect Shell's assets and employees/contractors, and specifically to ensure that Shell can comply with business control, anti-money laundering and/or anti-bribery and corruption laws and other regulatory requirements.

We will process your personal data only when legally permitted.

Automatic decision-making and profiling

All applicants must answer questions that are necessary to ensure that individuals can sign a contract with Shell under the law if they are successful in their application. In addition, for graduate hires, we use an online assessment tool that rates individuals on their suitability for employment, based on automated decision-making to ensure objectivity. In such cases, you will be notified of this and a member of the Shell recruitment team will be able to review these automated decisions. With the exception of hiring graduates or as specifically informed to you through personalized privacy policy notification during the recruitment process, no profiling or automated decision-making will take place to determine suitability or eligibility for employment or contractor hiring.

Who do we share your personal data with?

Why do we process your personal data?

We process personal data of Candidates only:

  • to take action, at the request of the Candidate, prior to entering into a contract;
  • where necessary in order to comply with a legal obligation to which the relevant Shell company(ies) is subject to ensure compliance with applicable employment and social insurance laws and regulations;
  • where necessary for the purposes of Shell's legitimate interests (such as ensuring compliance with legal obligations other than those relating to employment and social insurance laws and regulations, the protection of Shell's reputation and assets, employees and contractors), unless the Candidate's interests or fundamental rights or liberty override such interests;
  • (only where required by law) with the explicit consent of the Candidate.

In cases where the processing is based on consent, which you may provide otherwise, you have the right to withdraw your consent at any time. This will not affect the validity of the processing before the withdrawal of consent.

Who may we share your personal data with?

Your personal data is processed exclusively for the purposes referred to above and will be shared only when strictly necessary for the purposes of knowing with:

  • Other companies in the Shell group of companies, including those that may be outside your location;
  • Shell's authorised third-party agents, service providers, external auditors and/or subcontractors, in particular authorised third parties who carry out reference and background checks on Shell's behalf;
  • Competent public authority, government, regulatory or tax agency where it is necessary to comply with a legal or regulatory obligation to which the Shell company(ies) is subject or as permitted by applicable law; or
  • Any person to whom Shell intends to assign any of its rights and/or duties.

Shell is committed to protecting your personal data.

Interaction with Shell through social media

If you choose to interact with Shell through a social network managed by Shell ("Shell Social Network"), such as Facebook, Instagram, Twitter or LinkedIn, your personal data (name, profile picture and your interest in Shell), depending on the privacy settings set on the social media platform, will be visible to everyone who visits your personal page and also to Shell. You may delete at any time any information made available on these sites in your social media platform account. Shell does not monitor your activity on the different social networks you use. If you send a message to Shell via a social network messaging service, that message will be retained for a maximum of one month after it is received. Please contact Shell if you are unable to take action in relation to the Shell Social Network - see the section below.

In addition, and to the extent Shell is responsible in conjunction with the Shell social media platform, Shell will have access, through the social network, to a set of data with statistics and insights that help you understand the types of actions you take on Shell Social Media. For more information about how your personal data is processed on social media, including any targeted advertising you may receive, please refer to your privacy settings, accessible in your social media account.

Shell retains your personal data only for a set period of time

Transmission of your personal data to other countries

When your personal data is transmitted to companies that are part of the Shell group and/or authorised third parties located outside your country, we take organisational, contractual and legal measures to ensure that it is processed solely for the purposes mentioned above, and that adequate levels of protection have been put in place to preserve it. Among these measures are the Binding Corporate Rules for transfers between the Shell group and, for Shell companies in the European Union, transfer mechanisms approved by the European Commission for transfers to third parties, as well as any other local legal requirements. Your rights and how to exercise them.

Security of your personal data

We have implemented technologies and policies to protect your privacy from unauthorized access and misuse, and we will update these measures as new technologies become available, where appropriate.

How long is my personal data retained?

Subject to different retention periods set out in your location's data privacy policy, we retain the personal data of non-employment Candidates for a minimum of six months and a maximum of two years after the recruitment process or assessment, but retention periods may be subject to your location's privacy policy.

If your application is successful, personal data collected during the recruitment process will be retained in accordance with the Privacy Policy - Personal Data of Employees, Dependents and Contractors, available on your local website.

What are the consequences of not providing your data? 

The personal data requested and provided by Candidates is necessary in order to comply with legal requirements and/or to enter into a contract with you (or in the case of a contractor, your employer/service provider). Failure to provide the requested information, which is limited for the necessary purposes, will negatively affect your chances of being selected for any potential employment, hiring, or internship.

 

Your rights in relation to your personal data

Our goal is to keep your information as accurate as possible. You can request:

  • access to your personal data;
  • correction or deletion of your personal data (but only where it is no longer needed for a legitimate business purpose);
  • that the processing of your personal data is restricted;
  • the receipt of the personal data you have provided to Shell, in a structured and digital form, in order to transmit this data to a third party, if this is technically feasible.
